Terms of Service

These Terms of Service ("Terms") govern your access to and use of Crafty Servers (the "Service"), operated by Crafty Servers ("we", "us"). By creating an account, starting a demo, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Crafty Servers provides hosting for Minecraft game servers and related management tools. We may change, suspend, or discontinue features at any time.

2. Eligibility & accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you are under 18, you must have a parent or guardian's consent.
You are responsible for keeping your credentials secure and for all activity under your account.
You must provide accurate information and a working email address.

3. Plans, billing & cancellation

Free & demo tiers are provided as-is and may be paused, limited, or removed at any time (including for inactivity).
Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). By subscribing you authorize recurring charges until you cancel.
Cancellation takes effect at the end of the current billing period; you keep access until then. You can cancel anytime from your account.
Failed payments: if a charge fails, we may retry, and may suspend or downgrade the affected server after a grace period. Suspended servers' data may be deleted after a further period - back up anything important.
Refunds: if you cancel, your plan stays active to the end of the current billing period and isn't renewed - we don't refund partial periods for voluntary cancellations. If we cancel a paid account (see §7), we issue a prorated refund for the unused portion.
Account credits: to the extent permitted by applicable law, any account credit we issue expires 90 days after the date it is issued. Account credits are non-transferable, have no cash value, and may be used only toward future charges for the Service. If applicable law requires a longer validity period or does not permit a particular credit to expire, that longer period or restriction applies.
We may change prices with reasonable notice; changes apply to the next billing period. Our payment processor is Stripe. By using Stripe, you agree to their terms and privacy policy.

4. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms. Violations may result in suspension or termination.

5. Your content

You retain ownership of the worlds, files, and data you upload ("Your Content"). You grant us the limited rights needed to host, back up, and operate the Service. You are responsible for Your Content and for having the rights to use it.

6. Availability & disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee uninterrupted or error-free operation, and we are not responsible for loss of data. You are responsible for maintaining your own backups of Your Content.

Scheduled maintenance. For all plans, we reserve the right to perform brief infrastructure maintenance and rebalancing - typically up to 10 minutes of downtime during early-morning hours in your local timezone on alternating weekdays - to keep the Service fast, reliable, and low-cost for everyone. We aim to minimize disruption and to schedule it when your servers are least active.

Service credits. Without creating any uptime warranty or guarantee, and notwithstanding the "as is" and "as available" disclaimer above, if our platform or your paid game server is unavailable because of downtime we determine was caused by us or by our cloud infrastructure provider, we will, on request, apply a prorated usage credit to your account for the affected portion of your current billing period. This does not cover downtime outside our control, including issues with your own configuration, the mods or plugins you install, your network or device, scheduled maintenance (see above), suspensions under these Terms or our AUP, or events beyond our reasonable control. Credits offset future charges, have no cash value, are subject to the account-credit terms in §3, and are your sole and exclusive remedy for any unavailability, subject to the limitation of liability in §8. 7. Suspension & termination

We reserve the right to suspend or cancel any account - on any plan - for violation of these Terms or our AUP, or for any other reason, at our sole discretion. If we cancel a paid account, we will issue a prorated refund for the unused portion of the current billing period. You may stop using the Service at any time. On termination, your servers and data may be deleted.

8. Limitation of liability

To the maximum extent permitted by law, Crafty Servers will not be liable for any indirect, incidental, or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

9. Indemnity

You agree to indemnify and hold Crafty Servers harmless from claims arising out of Your Content or your violation of these Terms or applicable law.

10. Changes to these Terms

We may update these Terms; material changes will be posted here and, where appropriate, notified by email. Continued use after changes means you accept them.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.

12. Trademarks & non-affiliation

Minecraft is a trademark of Mojang Synergies AB and Microsoft Corporation. Crafty Servers is an independent business and is not affiliated with, endorsed by, sponsored by, or otherwise associated with Mojang, Microsoft, or Minecraft. We provide third-party hosting for game servers; any references to Minecraft or other games are nominative, used only to describe the software our customers choose to run. All other game, product, and company names are the trademarks of their respective owners.

13. Modpack Partner Program

If you join our Modpack Partner Program, you may earn a share of the revenue from paid servers that players run using your modpack on Crafty Servers. The revenue share, the payout schedule, and any minimum payout threshold are set out when you join the program and may be updated on reasonable notice. Whether a server counts toward your modpack is determined by us, acting in good faith.

For partners that earn more than $700 in a calendar year, tax forms may be required to issue a payout, which is handled by our payment processor, Stripe. Participation is non-exclusive: you stay free to distribute your packs anywhere and to work with other hosts.

You confirm you have the right to enter the program for the modpacks you submit and that hosting them infringes no one's rights. We may change, suspend, or end the program, or end an individual partnership, on reasonable notice; on termination we will pay any earnings you have accrued above the minimum payout threshold. The program is offered under these Terms together with any separate partner agreement we provide.
